Beware of Stream Global Services Part 6

What exactly am I trying to do? Why wouldn't I give up writing this blog and why wouldn't I just shut up? Let me start by quoting former US Congressman, J.C. Watts. He said, "Character is doing the right thing when nobody's looking. There are too many people who think that the only thing that's right is to get by, and the only thing that's wrong is to get caught." Let's face it, this is what's happening to some BPO companies nowadays. Lawyers that I talked to told me that there are no benchmark cases against call centers yet. Naturally, I asked why. They told me that the reason is simply because no case gets, well... finished - for lack of the proper legal term. Oftentimes, these cases/complaints filed against call centers gets settled out of court. Everyone knows that if a case is bench marked in the Philippines, then it will be much easier for people to sue abusive call centers.

What's happening is because call centers normally get these cases settled everyone wrongly thinks that they're not really doing anything wrong or illegal. As one commenter said in your humble servant's blog, "It's been done before in Etel (forced leaves), and other countless BPO companies... And will continue to happen." What our friend may be trying to imply is - if it's been done before and it's being done by a lot of people then it must be right and legal. Right? Wrong! It's just like smoking. I know a lot of people who smoke but that doesn't necessarily mean that smoking is right or healthy. Ask anyone who smokes and he or she will tell you that smoking is bad for our health and most of them would admit that if they can only find a will to quit, they would. Well every wrong seems possible today, and is accepted. I... we... simply refuse to accept it! That's one of the point we're making here.

I don't have any idea how this story will end. These 55 agents' concern in filing a case against Stream Global Services is for the proper authorities to know that we believe Stream did something illegal. Stream may hire the best lawyers in the land, bribe judges or other officials, but nothing will wipe away the fact that because of this blog - people would know what kind of people run this company. We may be powerless to beat a big company like Stream but I simply cannot sleep soundly at night knowing that I did not at least try to combat this injustice. My blog is my simple way of supporting the 55 agents affected by the forced leaves and warning those who do not know yet that there are way better call centers out there.

Someone said that, "You can easily judge the character of a man by how he treats those who can do nothing for him." Dear readers, can you say that you would like to work for bosses who treat their employees the way they treated my friends who were affected by the forced leaves? Of course not! SDM Cris Fernando, Nemanja Zec, and Area Manager Jojo Reyes may have started as agents and that's the more reason why I abhor their decision. There are lots of ways to remedy the issue that they were trying (or pretending?) to fix but what is right is often forgotten by what is convenient.

DO NOT PUT THE BLAME ON THE 55 AGENTS who worked their butts off for Stream Global Services! If their performance is poor - lay them off or retrench them! Terminate them if you dare! Just don't deny them their salaries for 30 days because you decided you don't need them. Admit it, you're doing this so that they would be forced to submit their resignations lest their families starve to death while waiting for Stream to recall them. That is inhumane and so inconsiderate.

The affected agents filed a lawsuit and I pray that justice be served because they were treated unfairly. They know that this is not going to be an easy fight. Former US President Thomas Jefferson said, "In matters of principle, stand like a rock; in matters of taste, swim with the current." This, my dear readers, is definitely a matter of principle! The same goes for my blog. The agents filing a case and me writing my blog is us dealing with all these things.

To the 55 agents, specially those who have filed a lawsuit against Stream Global Services - aim for the bench mark. Make sure that they don't get away with this!

If you think this blog is useless and not worthy of your time, then don't read it. It's that simple. But as long as there are people who care and read these "rantings," I'm here to stay.

  1. Just accept it. 55 agents are lucky they still have jobs, even if they didn't care enough to perform before. Injustice is that they are still employed. Injustice is that they still have benefits and if they choose, get to find another sucker company to give them a job while they still are employed. Injustice is that one sided garbage like yours still gets published. I read it to give the other side of the story that you choose to ignore. Families starve to death.... please. Let's not over dramatize this. If you cared about your family and didn't want them to starve, you would do better at your job. Get over it and get better at your work then whine about it.

    I guess your one from the management or one of the kiss-ass TM`s or one of the "alipores" of those kiss assers who also kiss ass the kiss assers (whatever).

Sleep well, im not one of the 55 agents, but i know my friends..some are even better and loyal to the company more than me. and the data that they have used are more than ridiculous, imagine on the stack ranking - the top 1 agent - resigned for almost 2 months, the top 2 agent - csat and all metrics are n/a and the only metric he have is revgen and the top 3 agent - we barely see because she is always absent or on halfday AND SO ON.. how good is that?! they didnt even look or examined the data - because THE POINT IS - THEY JUST WANT 55 AGENTS OUT. period.

    SO SHUT UP. Most of the 55 agents theyve put on FL, performed well, goes to work early, does not go on absent, one is even the agent of the month, some are even the reason 6j became the best 6j worldwide.

    In the end of it all, everything just fits. 55 agents that can't hold on to their jobs because they are incompetent and Stream Management incompetence on the stack ranking. You deserve each other. Sue each other and maybe SGS will get their act together and the 55 can go back to work at Jolibee or becoming a nurse like they were suppose to.

    I'll just shout up now...hahaha. Fools.

  7. To the Heartless Monster (LOL!),

    Your argument is just running around in circles. We understand what "just accept it" means. No need to reiterate it. If it looks like we're not getting it - maybe that means either we don't accept it or maybe there's really no substance in whatever you're saying. Or maybe both.

    Most of the points I'm trying to make are in my blog, in Part 6 particulary. You haven't really said anything to refute it so I'll just let it stick for now. You're good in English and you're equally competent in getting under people's nerves. You're reasoning though, leaves much to be desired because for whatever reason you chose to elaborate on your points. I guess it's "less talk, less mistake" right? :-)

    Just accept it. You may be comfortable sitting where you are right now, but the world is not always seen from a bird's eye view. Even God had to come down from the heavens to live with his creation in the form of a human savior.

    We'll keep doing what we're doing here and you can just mind your own business. Again, if you think my blog is garbage don't forget that I didn't invite you to read this. My opinion here will hold because I'm the author. You don't like it? Then don't read it. Grow up and deal with it. Hahaha.

  9. after reading the above comments, I think the point that needs to be elaborated is that filing a case won't do anything. Oftentimes, yes they are settled out of court... why? because the burden of proof is just too difficult. SGS wouldn't do this without coaching logs, stack rankings, every legal tool in their arsenal. Agents will come back with stack ranking is flawed, etc. DOLE or whoever isn't going to bother with it. Looking at things at CSAT, RevGen? it's not their realm and it's not their business. Maybe in the end, i agree it's not the 55 agents fault (at least some, let's be honest, there are probably some that deserve forced leave) but in the end, it's purely business. Benchmarking a case won't happen because there are just too many factors that play into letting agents go/forced leave/retrencement. Call volume, labor margins, etc. It's what every center goes through and honestly i don't think the government is going to screw with the CC industry.

  10. I was able to get info from a reliable source that Mr. Excel did not compute the stack ranking, all names were inserted on Stream's PCOS machine and after a few minutes(thanks to automation). Those 55 agents were indeed at the bottom of the list -Site Director from TAWI TAWI

  11. do you think you'll be flaming up your keyboard if you weren't affected by this? because from the looks of it, you're like a baby crying over spilled milk. company has reasons. i was put on the temporary leave shit, too. i felt the same way as you did but i realized it is better than being terminated for no grounds at all or bringing the whole program down.it's a very bitter pill to swallow but i can't let my personal interests pull down everybody. you should have known from the start that this is how we are going to be treated. don't expect a support community or foundation for jobless call center agents or at least some consideration form the management. this job is easy come and go. i feel the same way here, too, but like what they say: "Shit happens" and like what you mentioned on your entry, swim with the current if it's the current taste. unfortunately for us, we're the flavor of the month.

  12. Amen. My point exactly. Sorry if you think am being heartless, but that's the way it is. SGS will rehire agents and do this in another program (Dish? Sirius?) truth is old Stream (Barbie, Kurt) were crap managers that didn't get the job done. Honestly, if you like the management, it means they aren't doing a good job. The 55 agents were excess, and should have been removed a long time ago. Stack ranked sooner or later. Granted, I'll take your word for it, revise the stack rank. You'll still be out 55 agents.

  13. @ Anonymous A - Actually filing a case will do "something." For one, if these agents will not get a bench mark for the case, they can have Stream Global Services pay them back wages for the days they were not allowed to go to work. True, getting a bench mark for the case is not going to be easy but let's face it, there's a reason why call centers settle cases out of court. And out-of-court settlements, as we all know, involve money. Let's not forget the fact that these agents were forced to be on leave "without pay." Personally, I would like them to go for bench mark even though it's going to be more difficult. But that's just me. Those who filed the case will have the final decision on that. Like I said, I'm not a law expert and it is up to these agents' lawyers to strategize on how they will get a court decision favorable for the plaintiff.

    @ Anonymous B - I am proud to say that yes, I am affected. Whether or not I am one of the 55 agents on forced leave will not change that fact. Perhaps, I'm a baby crying over spilled milk. That speaks of how much I care for these people and how affected I am by the recent turn of events.

    I disagree, though, with your reasoning. Thinking that things could go from bad to worse is not really a bad idea. That's looking on the bright side of things. But sir/ma'am, if one will be terminated without cause, then you can still sue for illegal dismissal. I personally know 3 people from call centers who either won on lower courts or was paid a large sum of money because they have been illegally dismissed. If the account will close down, people get retrenched. Unless the reason is bankruptcy which a company will have to prove as well. Either way, there are due processes to follow or companies can be sued. Besides, thinking that worse things can happen does not justify Stream Global Services' decision to resort to forced leaves. It won't make it right.

    I'm not looking for a foundation, a support community, or more so - a consideration from the management. Yeah, "shit happens." This is their shit, so let them clean things up. I agree with you - this is a bitter pill to swallow but this is one pill that shouldn't be swallowed. I just want to inform as many people as I can about what's happening here. If they will take action, OK. If not, it's also OK.

    I believe that what the Stream Global Services' upper management did is wrong. And I can't live the rest of my life thinking that I did not do anything to fight this.

  14. @ Anonymous C (or A again?) - I only know the two former Stream bosses you mentioned professionally. I am not in a position to say whether they did a good job because well, they don't answer to me. It's actually the other way around. All I know is this - under their leadership no agents were treated unfairly. At least in HP. I can't say the same for the other accounts.

    If the 55 agents were excess employees, then they can remove them BUT (again!) there is a due process for that. The reason for this problem anyway is that they did not follow that.

    Granted that 55 agents really need to go, what's so difficult about CAREFULLY and METHODICALLY stack ranking them so that there will be no issues about it? Then go ahead and inform the HP PSG agents IN ADVANCE that the company will be removing some of them and the selection process will be their performance. Is that so difficult to do? At least, the agents who might be affected may be able to prepare their back-up plans. If they only considered doing these things - I wouldn't be writing this blog.

No, I did not expect that Stream Global Services will treat its employees unfairly. What I expect is that if my job performance is not meeting their expectations or requirements granting I did everything I can to the best of my abilities, I may lose my job but I will be treated fairly - MEANING, due process will be followed in releasing/terminating me.

    No wonder you can suck up everything that's happening to you. You ought to have some sense of self-worth or self-respect. It's not bad, you know?

  30. this is also happening in legacy etel sites.. most especially the provincial sites. Cebu and Clark. support positions have been moved to manila and these folks were asked or shud i say forced to do call handling.. wtf!

  34. After careful assessment and research regarding these issues... It seems that we are missing some critical points on why this unfortunate event occured...

    1. It was a decision on the business side to keep the business rolling, harsh it may seem but it's true. It was the delivery of the decision that was wrong. Before the forced leaves were handed out, the account was already losing revenue for more than 2 months. Whatever happened should've been foreseen long before the rash decision was made. Why is it that a lot of us were unaware? Leads out to the previous management.

    2. There was already a formula for stack ranking agents which the person/s who created the stack ranking that time already knew but didn't use it. (Ask around why and you might hunt them down)

    3. Regarding legality of what SGS did, unfortunately it is legal. I quoted this from someone in the web who had a similar experience

    "Work days may be reduced on account of losses. The reduction in the number of regular working days is resorted to by the employer to prevent serious losses due to causes beyond his control, such as when there is a substantial slump in the demand for his goods or services or when there is lack of raw materials. This is more humane and in keeping with sound business operations than the outright termination of the services or the total closure of the enterprise."

    Roughly the same response DOLE gave me over the phone when I inquired regarding the situation.

    The situation changes though if the forced leaves would exceed 6 months which would then be considered termination of employment. It would be very difficult to let the case ride on grounds of Constructive Dismissal since there is nothing heinous nor did the company laid down the decision without probable and just cause (wrong formula used in the stack ranking might be used as a lverage as well as the non-notification and immediate implementation of the action might be used to support unjust but it ain't enough). Just a suggestion for the affected people, still need to dig deeper into this coz SGS can turn things around if actions are taken without careful assessment.



    One thing though, just like my TM said, and I quote, "maraming mas deserving matanggal dyan, bakit hindi pa sila..) And I agree with that, check the floor and observe how many incompetent overpaid promoted people are there...

    Oh and regarding the words from the IPG STMs, the reason IPG still flourishes is because of stats manipulation. Funny thing about it is that the TMs actually approve it and even encourages the agents to continue such a practice. Dunstan and Donna needs to wipe their a**es first before letting out a roar.

  35. ^ Thank you for the above comments. I was aware of some of these facts, too. Let's see how the NLRC or other courts will decide on the case filed by the affected agents.

    As for "constructive dismissal," it will be up to the affected agent's lawyers to prove. After all, the main reason for this blog is to inform other people in the BPO industry what's happening here in Stream Global Services. This is so that if they are seriously contemplating thoughts about joining this company, they may rethink about it first.

    As for updates: None yet. The hearing will be on July 7, 2010 though.

  41. haist To the HEARTLESS MONSTER... typical na yang mga ganyang tao galeng galeng nya mag english ha amfufu palong palo parang gago lang nyahahahha... pero the fact is malamang nga isa sa mga buntot at kasamahan yan ng mga tm na nagyoyosi sa labas ng stream kapag 15 min break or lunch break... haist.... sana di mangyari yang ganyan sa iba... and marami din talga ako napansin sa stream na against sa labor code but one thing for sure stream keeps my daily needs sufficient ^_^ much better than to go abroad (kung matyaga ka and kuntento ka sa ngaun) ^_^V

  43. Hay naku ganyan din yung sabi nung cousin ko na nagwowork sa clark. I heard they are screwing up the employees' salary and putting people on TLO or an absurd performance improvement plan para matanggal sila agad within 3 months time. Ang masama these are tenured people na tig-teten years and above kung ayaw daw sa sweldo pinapagresign. Im sure iniiwasan lang nilang magbayad ng redundancy pay. Tsk! Tsk! Tsk! I wonder if there are media people interested in this story.

  44. Ayooos! This blog is telling the exact truth about this cold hearted company! Totoo yung lahat about Stream. Some employees here in Cebu also filed cases in NLRC,i-TLO ba naman ng walang basis?... Yun sa Clark naman daw, nagform ng Union. Ayun, nabulabog ang mgmt! Now the bosses turn to all sorts of dirty tactics and union busting moves like threatening to blacklist an agent, sending black propaganda text messages and... the notorious poison letters na so obvious na gawa lamang ng management and their cohorts na gustong umangat ang position nila. We plan to call them nga to ask how they started their Union. Buti na lang independent sila and not affiliated with leftists and rightists groups. They started din daw by asking legal advise first.

Besides instead of wasting your time blogging, why don't you go and get yourself another job. People like you love to complain when wronged but when you were still actively working at Stream, you did nothing but browse and chat and spend all your time in just one call after making a sale.Talk about being a productive employee.   48. i work at stream, and all the bullshit they cause, just goes in one ear and out the other, because if u actually cared about the company it wouldnt make any difference!, stream only has one thing in mind, and thats stream, no one else, they lie to there contracts and there employees, i have been working there for 5 years now, and havent ever taken anything they said seriously because the company is mis managed, and 99% of what they tell me goes in 1 ear and out the other, if i actually took what they said to heart id prolly be fired, the company doesnt use logic or common buisness prectices, im actually supprised the company still exists due to the lack of managment skills, but if stream has tought me anything, is that 1 never believe what they say, and 2 there actually is a place called hell!

  49. Sorry, for the late update. I've been busy lately and frankly, there isn't much to talk about the past few weeks about this "on-going" case. I'm surprised that numerous comments have been posted in this blog since the last time I updated it.

    To the well-wishers and supporters, a big, big thank you to all of you. It really feels good to know that people read this blog and that people care about what has been happening in our company.

    To the skeptics and haters, I've got nothing much to say to all of you except - "read on," because there's more to come.

    To the anonymous commenter who called me Jason or Saj - you're wrong. That's all I have to say about that. No clues for you and better luck next time. LOL!

    and being one of the top ranking agent for 4years. Don't brag that you gave us the job! Its you who needs us. Individual commitment is what makes the company work. STREAM won't last for the next 5years.

Paano kaya para mag back out ang client? Through sensitive info kaya? The dissemination of info started already. Only time will tell kung kailan malalaman nang mga cliente niyo!!!

  52. Wow! bat di ko agad napansin ang blog na to. We have 4 cases against Stream here is Clark. We are just waiting for the decision of NLRC. Take note of our tenure, more than 10 years then suddenly we were fired because of not hitting the goals. Well, we admit it. We did not hit the goals but why? Is it because of lack of support, motivation or we are just supporting a defective software of a client.

    Before Stream acquired eTel, we were an in house service center of AOL. No one thought of leaving the company because of the good management. eTel came in and we still feel secured. Now, comes Stream. Everything became a jungle. Survival of th fittest. If you are a TM or a manager and you failed to meet the goals, they will fire you but they will pay for separation pay and they will tell the agents that you were not fired because of non performance but due to redundancy but if you are an agent and you did not meet their goal, you will be terminated with no separation pay.

    Please pray that we will our case against this company.

  53. About the union at Clark. Wala pong nangyari dahil nabayaran yung ibang leaders. It sucks kasi yung ibang tunay na leaders naiwan sa ere. Sino pa maniniwala sa kanila.

    Sana yung mga kaso namin maipanalo naman namin kasi ten years kami and full of awards pero pagdating ng Stream nasira lahat and take note, we are not ordinary starters, we are very experienced and tenured agents na gustong palitan ng murang paswelduhin na di rin naman masikmura and patakaran at umaalis din agad.

    Sa mga nasa Stream pa, don't be afraid of moving your cheeses, maraming opportunities outside. Nakakamiss lang yung parang family na relationship namin nung AOL pa kami.

  54. Stream is blamed because of worst asshole management led by Anant Singh,who doesnt care for ex employess and Sony the bitch who is still is Stream.This people are mosquitoes feeding blood of hardworking employees.
    These are the pest that should be completely eradicated from Stream and others.
    There were Atul Palekar and Vishal Poojari ,honest people who didnt last long for their honesty.

    They recently started with Dell Marathon and no one yet received yet as a result many left not only because of this but also their has been loop hole due to which employees dont get what they deser

  56. I'm also a slave to "Stream Global Services" and can agree with most of what's said here. And no matter what country you're in, what color you are, or what economy you live in, you're treated equally. They run this company for one thing and one thing only, FOR THEIR OWN BENIFIT AND NO ONE ELSE. How many billions of dollars can we make, how many employees can we burn out or kill before we destroy enough of the economy to pack up and leave. I know people who have worked for this company for at least 5 years, have top stats and have absolutely NO TENURE. When a shift bid comes, the same people get shifted to a shift they hate because 1 stat is down, and it's a stat they are unable to control. You know, like CSAT, when you get a bad one because the customer didn't like the agents before you and you happened to be the last person on the case. Everything else is top stats but this, but you're still dropped to the bottom of the list. Convenient. When they say they're and how fast can we make it? And when you have so many technical issues and you constantly ask for help and assistance and have to wait 20 - 30 minutes at a time because no one knows how to handle the issues when they arise. They never take a customer's word, no matter how insistant the customer is and feels they are correct. If there are no notes completely stating the entire issue and why something was done and why it wasn't, then the customer is ALWAYS wrong. Doesn't matter if that particular agent just didn't feel like taking notes that day.

    I understand the struggling ecomony we live in and the fact that there are not a lot of jobs out there to choose from these days. And so do they, they understand it well. That's precisely why they bring these 'jobs' and all this 'prospect' into the places that need work the most. They know they will have a lot people looking for jobs in the area so that's a good way to fill their seats. They get subsidized for being there and bringing the work, yet they only pay about a 3rd of what is allocated for them. Where's the rest of the money going? How is it justified when one country gets paid 'working-poor' wages for the same job another country gets paid top dollar for? They barely give above minimum wage and the stress they push on their workers is insane. For the way they treat their workers, everyone should be driving a brand new car and have a lot of luxuries. None of them should have to be living from paycheque to paycheque. I can guarantee these managers and corporate people are still flying their private jets and cruising around in their convertables.

    The frontline agents are the ones that suffer to keep these clowns rich. The frontline agents are the ones who have to struggle to live. Not all of us can just pack up and go to another place if we can't find a job, not all of us are that fortunate. And what about the sick ones? The ones who can't get benifits from there because they only work certain amounts of hours. The ones who are only supposed to be scheduled for set amount of hours, then they just increase the hours at their own because you need training and it can't be during a scheduled shift. All in the name of numbers and stats. Nothing humane about it.

    I love when they say 'Keep a smile on and don't bring your problems to work'. The people that write these rediculous statements are the people who don't worry about money and have no problems at home.

  57. Some people are just too damn smart to know when to stop arguing and debating on things that they do not have total understanding of. Why don't we stop coming up with debates that can neither be proven true or false. I worked with Stream but I never found my self burdened by any issue. I work, get paid and as a result my family doesn't starve to death (over-dramatized). Stream has legal advisers and I do not think that Stream is stupid enough to come up with irrational decisions that could jeopardize their credibility and stability. Surely none of us know the other side of the story. All we have are speculations. Speculations create doubt and a single doubt can ignite a thousand more.

    A perfect company does not exist. At the end of the day its all about our own choices and these choices are actually affected by the way we react to situations and how we behave professionally. We certainly do not control over a lot of things. What do we have control of, then? Our attitude or behavior.

    I suggest we end disparaging comments, work hard, help the economy and sleep well.

    If anyone plans to refute me or comment against me, let me tell you this folks: There is a big ass difference between being a fool and being wise. Do not confuse these two as synonyms. If you can not read between the lines or if you don't get what I mean, sucks to be you.
